Revision of MOMENTICA Terms and Conditions (to in effect from September 26, 2023)

Dear MOMENTICA users,

Thank you for your continuous support! We would like to note that there will be an update to the Terms of Service as follows.

Newly established Special Rules on Japanese Users in our Terms of Service will be included as part of the Terms of Service as of September 26, 2023.

If you do not express your intention to amend the revised Terms of Service by the day before the effective date, you will be deemed to have agreed to such revised Terms of Service. If you do not agree to the Terms of Service, you may withdraw your membership (membership withdrawal).

Added clauses at the end of Article 1.4:

(c) Step Count. Users have the capability to transmit step count data through walking and send these accumulated steps to a specific TAKE. Users may then choose to publish the accumulated step count data in forms such as step count achievement screens or Certi Pics on the platform. It is important to note that we provide this feature by obtaining step count data through third-party companies, contingent upon the user’s consent.

(d) Documenting Everyday Life. Users can utilize the “Certi Pic” function to capture photos or videos, or capture the screen, with a specific TAKE visible within the photo, video, or captured screen. Users may subsequently create and post photos, videos, or captured screens with a TAKE displayed on the platform.

(d) Decorate TAKEs. Users have the authority to affix and change the frame image (hereinafter referred to as the "Top Loader") around TAKE. Furthermore, users may decorate the TAKE using stickers or other images on the TAKE itself or on the Top Loader.

Added Article 3.5: 

Management and Operation of Posts.

1. You are solely responsible for any issues arising from the Content you create, such as Top Loaders and Certi Shots, or the uploading and posting of Content.
2. In cases where the Content violates service operation policies and laws as outlined below, posts may be deleted without prior notice in accordance with service operation policies, and usage restriction may be imposed on the use of the service.
   1. Content that damages the likeness of Artists; 
   2. Content containing material that may cause discomfort to artists and other fans (insults, defamation, coercion, obscenity, harassment, threats, etc.);
   3. Any malicious posting of messages and indiscriminate uploads within the service community;
   4. Content that infringes on the rights of third parties, such as copyright, intellectual property rights, and portrait rights; 
   5. Content that denigrates or defames other users or third parties, causing harm to their reputation through insults or false accusations; 
   6. Commercial content such as advertisements or promotions by third parties; 
   7. Content that is deemed to be associated with criminal activities; and 
   8. Any other content that may adversely affect the service environment, even if not specifically mentioned, may be deleted without prior notice in accordance with the service operation policy.
3. Please note that refunds are not available for paid transactions that have been reported and deleted due to violations of service policies and laws. Please use the service with caution.
4. If posts created by you contain inappropriate words specified by Levvels, they may be rejected for posting without prior notice.
5. Levvels may take permanent deletion measures for posts received through reports, following the service operation policies.
